By accessing or using the NitroShock website, the NitroShock application, or the WordPress plugins we publish (together, the "Service"), you agree to be bound by these Terms. The Service is operated by DevWave Software Inc. ("we", "us"). If you do not agree to these Terms, do not use the Service.

2. Description of Service

NitroShock is a search and AI visibility platform. The Service includes:

• Rank tracking, site audits, keyword research and competitor analysis
• AI visibility monitoring, which checks whether your brand appears in AI generated answers
• Content writing and on-page optimisation tools
• Optional integrations you authorise yourself, such as a read-only Google Search Console connection
• WordPress plugins we publish
• A credit-based usage system, with free tools and free starter credits so you can evaluate the platform before buying

3. User Accounts

3.1 Account Creation

To use certain features of the Service, you must register for an account. You agree to:

• Provide accurate, current, and complete information
• Maintain and promptly update your account information
• Keep the email account you sign in with, and your NitroShock account, secure
• Accept responsibility for all activities under your account
• Notify us immediately of any unauthorized use

3.2 Account Termination

We reserve the right to suspend or terminate accounts that violate these terms or engage in fraudulent activity.

4. Usage Terms

4.1 Acceptable Use

You agree to use NitroShock only for lawful purposes and in accordance with these Terms. You agree not to:

• Violate any applicable laws or regulations
• Infringe upon intellectual property rights
• Generate harmful, offensive, or illegal content
• Attempt to reverse engineer the Service or circumvent its usage limits
• Share your account credentials with others
• Use automated systems to abuse the Service

4.2 Credit System

NitroShock operates on a credit-based system:

• Most features consume credits; some tools are free to use
• Different features consume different amounts of credits
• Credits are non-transferable and cannot be exchanged for cash
• Credits do not expire
• Purchases are final, except as set out in our refund policy

5. Intellectual Property Rights

5.1 Our Property

The Service and its original content, features, and functionality are owned by us and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

5.2 Your Content

You retain ownership of content you create using our Service. However, you grant us a limited license to use, store, and process your content to provide the Service.

6.1 Pricing

Our current pricing is displayed on our website. We reserve the right to change prices with 30 days' notice.

6.2 Payment Processing

All payments are processed securely through our third-party payment processors. We do not store credit card information on our servers.

6.3 Refund Policy

Because you can evaluate the platform with free tools and free credits before buying, purchases of credits and software licences are final. We correct billing mistakes, such as duplicate or incorrect charges, as described in our refund policy. Nothing in these Terms limits any refund or remedy you are entitled to under applicable consumer protection law.

7. Disclaimers and Limitations

7.1 Service Availability

We work to keep the Service available but do not guarantee uninterrupted service. The Service is provided "as is" and "as available."

7.2 Limitation of Liability

To the maximum extent permitted by law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages resulting from your use or inability to use the Service.

7.3 Indemnification
